§1 General information

1. The operator of the themarstore.com website is: THE MAR sp. z o.o. with its registered office in Warsaw, ul. Siedmiogrodzka 1/308, 01-204 Warsaw, REGON 389764664, NIP 5272968505, which is the controller of personal data. You can contact the Controller of personal data by e-mail: office@themarstore.com or at the company’s registered office. The Controller has not appointed a Data Protection Supervisor. The Controller takes measures to protect against unauthorized access or disclosure of user data to third parties.

2. The website collects personal data about users and their behavior in the following ways:
a. through personal data voluntarily entered by users in forms,
b. during purchases and order fulfillment,
c. through users subscribing to the newsletter,
d. through cookies being stored on end devices,
e. through the collection of web server logs by the hosting provider via a dedicated server.

3. Personal data are collected for the following purposes:
a. necessary to establish, shape the content, change, terminate, and properly implement services provided electronically and fulfill user orders for products in the store’s assortment, deliver goods, and process payments,
b. to process complaints and reimburse benefits in the event of withdrawal from the contract (return of goods),
c. to send the newsletter,
d. to conduct direct marketing of products or services, including establishing contact, presenting offers, conducting measurements and analyses, including profiling, storing data in cookies, and collecting data from websites and mobile applications – based on the user’s consent (Article 6, paragraph 1, letter a of the GDPR in conjunction with Article 172 of the Telecommunications Law),
e. to fulfill user requests, establish, pursue, or defend against legal claims, and to archive data (Article 6, paragraph 1, letter f of the GDPR).

4. Data recipients. In cases where it is necessary for the services performed by the Controller or to meet a legal obligation, users’ personal data will be transferred to:
a. authorized employees and associates so that they can perform their duties,
b. payment processors available on the Website,
c. entities providing courier services to the extent necessary to process order deliveries,
d. entities providing satisfaction survey services to the Controller,
e. public authorities, if such an obligation is imposed by applicable law.
Personal data will not be transferred outside the European Economic Area.

5. Legal basis for personal data processing. The Administrator processes users’ personal data in accordance with applicable law and expressly granted consent.

6. Data processing time. Personal data will be processed for the period necessary to achieve the purposes indicated in this document, in particular order fulfillment and for a period corresponding to the limitation period for claims related to purchased goods, and after that time to the extent required by generally applicable law. Furthermore, personal data are processed for the duration of the Administrator’s marketing and commercial activities, as well as for purchase satisfaction surveys, or until the user withdraws their consent.

7. Rights related to personal data processing. In connection with the processing of personal data, the user has the following rights: the right to access personal data; the right to request rectification (correction) of personal data; the right to request deletion of personal data (also known as the right to be forgotten); the right to request restriction of personal data processing; the right to data portability; the right to object to data processing; the right to withdraw consent at any time without affecting the lawfulness of processing based on consent before its withdrawal. Each data subject has the right to lodge a complaint about the processing of their personal data by the Controller with the supervisory authority for personal data protection.

8. Voluntary provision of data. Providing personal data is voluntary; however, failure to consent to the processing of personal data by the Administrator may prevent the provision of services electronically and the making of purchases in the store. Consent to the use of personal data for the Administrator’s marketing and commercial activities, as well as in connection with the purchase satisfaction survey service, is voluntary. Failure to consent will result in the user not receiving the above content.

§2 Information in forms

1. The website collects information provided voluntarily by the user.

2. The website may also save information about connection parameters (time stamp, IP address).

3. The data in the form is not made available to third parties except with the user’s consent.

4. The data provided in the form may constitute a set of potential customers, registered by the Website Operator in the register maintained by the Inspector General for Personal Data Protection.

5. The data provided in the form are processed for the purpose resulting from the function of a specific form, e.g. to process a service request or commercial contact.

6. The data provided in the forms may be transferred to entities technically implementing certain services – in particular, this concerns the transfer of information about the holder of a registered domain to entities that are operators of internet domains or payment systems with which the website operator cooperates in this respect.

§3 Information about cookies

1. The website uses cookies.

2. Cookies are computer data, specifically text files, stored on the Website User’s end device and intended for use with the Website’s websites. Cookies typically contain the name of the website they originate from, the duration of their storage on the device, and a unique number.

3. The entity that places cookies on the Website User’s end device and obtains access to them is the Website operator.

a. creating statistics that help understand how Website Users use websites, which allows for the improvement of their structure and content,

§4 Server logs

1. Information about certain user behavior is logged at the server level. This data is used solely for the administration of the website and to ensure the most efficient operation of the hosting services provided.

2. Viewed resources are identified by URL addresses. Additionally, the following information may be recorded:
a. request arrival time,
b. response time,
c. client station name – identification performed via the HTTP protocol,
d. information about errors that occurred during the HTTP transaction,
e. URL address of the page previously visited by the user (referrer link) – if the Website was accessed via a link,
f. information about the user’s browser,
g. IP address information.

4. The Store ensures the security of personal data through appropriate technical and organizational measures aimed at preventing unlawful processing of data and their accidental loss, destruction and damage.

5. The Website takes special care to ensure that personal information is:

b. obtained only for specific purposes and not further processed in a manner incompatible with those purposes,
